THE PROMOTION IS OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES OR D.C. WHO ARE 21 YEARS OF AGE OR OLDER AT TIME OF ENTRY. VOID WHERE PROHIBITED.

PRIZE DOES NOT INCLUDE AIRFARE, GROUND TRANSPORTATION, OR PARKING FEES. TRAVEL TO AND FROM THE CRUISEPORT WILL BE AT THE SOLE RESPONSIBILITY AND COST OF THE WINNER.

1) PROMOTION PERIOD: The Wave Season CCNE Sweepstakes (the “Sweepstakes” or “Promotion”) starts on March 25, 2024 at 12:00:00 AM Eastern Time (“ET”) and ends on April 25, 2024 at 11:59:59 PM ET (the “Promotion Period”). Administrator’s computer is the official time-keeping device for this Sweepstakes.

2) ELIGIBILITY: The Sweepstakes is open only to legal residents of the fifty (50) United States or the District of Columbia who are 21 years of age or older at the time of entry. Employees of the Massachusetts Port Authority (the “Sponsor”) and its respective parent company, related subsidiaries and affiliated companies, Holland America, advertising and promotion agencies including Marden-Kane, Inc. (the “Administrator”) and each of their respective agents, representatives, officers, directors, shareholders, and employees (collectively “Released Entities”), and the immediate families (spouse and parents, children and siblings, and their respective spouses regardless of where they live) and individuals living in the same households, whether related or not, of the above, are not eligible to enter or win the Prize. Each entrant (the “Entrant” or “Participant”) by participating in the Promotion agrees to be bound by the Official Rules and by Sponsor’s and/or Administrator’s decisions, which are final and binding in all matters related to this Promotion. Void wherever prohibited or restricted by law. This Promotion is subject to all applicable federal, state, and local laws and regulations.

3) HOW TO ENTER THE SWEEPSTAKES: To enter, go to www.cruise-fcb-2024.com and follow the on-screen instructions. You must complete and submit the entry form as instructed to be eligible. As part of the Sweepstakes entry process, Entrants will be required to indicate that they have read, accept and agree to be bound by these Official Rules. Any entry information collected from the Sweepstakes shall be used only in a manner consistent with the consent given by Entrants at the time of entry, with these Official Rules, and with the Sponsor’s privacy policy which can be found at https://www.massport.com/massport/about-massport/privacy/.

Proof of submission of entry does not constitute proof of receipt of entry. All entries become the property of Sponsor and will not be returned to Entrants. By completing and submitting the required information the Entrant will receive one (1) entry into the Sweepstakes (the "Entry"). Limit of one (1) Entry per person per day. For the purposes of this Promotion, a day is defined as the calendar day beginning at 12:00 AM ET and ending the same day at 11:59 PM ET. Entries received in excess of the limits stated herein will be void. Any entry information collected for/from the Sweepstakes shall be used only in a manner consistent with these Official Rules. Once the Entry has been verified, the Entry will be included in the Random Drawing as detailed below in Rule #4.

4) RANDOM DRAWING: One (1) potential Prize winner will be selected in a random drawing on or about April 26, 2024, from among all eligible Entries received in the Sweepstakes. The random drawing will be conducted by the Administrator, whose decisions are final and binding. Odds of winning depend upon the number of eligible entries received. The potential winner is subject to eligibility verification and compliance with these Official Rules.

5) PRIZE: A 21-day Caribbean cruise for two (2) on the Holland America Line® ship Zuiderdam departing from the Raymond l. Flynn Cruiseport in Boston, Massachusetts on October 19,2024. Cruise accommodations will be in one (1) shared Ocean View Category stateroom which includes port and tax expenses associated with the cruise. Meals are included in all complimentary restaurants on board the ship. Gratuities are the responsibility of the winner and guest. Total Approximate Retail Value of Prize: $3,470.

6) PRIZE RESTRICTIONS: No substitutions or cash equivalents permitted except at the sole discretion of the Sponsor, who reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, except as otherwise provided herein if the advertised Prize becomes unavailable. All travelers must possess required travel documents (e.g., passport, valid photo ID) prior to departure. Winner and guest must satisfy all COVID-19 vaccination and testing requirements that are in place at the time of sailing. Prize winner and/or guest must possess/present at least one major credit card in good standing in order to set up an onboard account. All other expenses and incidentals not specifically stated herein are excluded and are winner’s sole responsibility including, but not limited to, taxes, air transportation, ground transfers/transportation, hotel overnights pre/post cruise, alternative “for-charge” dining venues, alcoholic beverages and soda, internet, local and long distance phone calls and other items normally sold for-charge, port charges and taxes, shore excursions, souvenirs/gift shop purchases, spa services, laundry service, luggage fees, meals off the cruise, travel documents (including applicable passport, visa and entry/exit fees), personal onboard and incidental expenses, gratuities and service charges. Transportation to/from the Cruiseport and Cruiseport parking is excluded. Prize consists of only those items specifically listed as part of the Prize. No more than the listed number of prizes will be awarded.

The prize will be fulfilled by Holland America Line® (“Holland America”) and is subject to its terms and conditions. Winner must book a cruise for the 2024 season. No extensions will be permitted. Winner will receive special booking instructions from Holland America. Subject to the terms of Holland America Line Cruise Contract which must be accepted when registering online for your cruise. Winner and guest agree to comply with all applicable cruise regulations and the Winner and guest must individually read, accept and sign the Cruise Contract and the Covid-19 Risk Acceptance on his/her own behalf and on behalf of any eligible minor guest. These documents are required before boarding. Winner and guest are not eligible for Holland America Line’s Cancellation Protection Plan programs in connection with the Prize. Itineraries are subject to change. Certain blackout dates and restrictions may apply. Winner and winner's guest must travel together on dates specified by Holland America or may forfeit the Prize. Holland America’s determinations regarding the awarding of the Prize is final. No Prize substitutions except as provided herein. All guests under the age of 21 must be accompanied by a parent or legal guardian. The winner must stay in the same stateroom with such guest, and must sign and return all required documentation on behalf of such guest. Prize is valid only for the winner of the Prize, it is not transferable and may not be given, bartered, sold, or exchanged for cash or another prize and cannot be used as partial payment toward a different Holland America Line cruise, except at Holland America's sole discretion due to Prize unavailability for any reason and then only for a prize of equal or greater value. Prize winner is solely responsible for obtaining any travel insurance (and all other forms of insurance, including medical insurance) that they wish to obtain at their own expense and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance.

Sponsor makes no warranties, and hereby disclaims any and all warranties, expressed or implied, concerning any prize furnished by third parties in connection with the Sweepstakes. All details of the Prize not specified herein shall be determined solely by Sponsor.

Sponsor shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by any cruise line or any other persons providing any of these services necessitated by same. In the event that the Prize cannot be fulfilled for reasons including, but not limited to, scheduling conflicts, cancellations, postponements, delays, an event of force majeure (any acts of God, natural catastrophes, public enemies, war, acts of terrorism, civil commotion, riot, strikes or labor difficulties, lockout, judicial or government order, pandemic, or other requirement of law, or national emergencies or any other cause beyond Sponsor’s reasonable control), or for any other reason whatsoever, then the Prize will not be awarded, and no compensation will be provided.

Once scheduled, the Prize itinerary cannot be altered and failure of the winner to follow such itinerary shall not obligate Sponsor in any way to provide such winner with alternate arrangements. Winner and guest are responsible for all required and necessary identification and travel documents including providing proper citizenship documentation to travel, which may include passports, valid alien registration card and/or necessary visas, as well as for obtaining and providing proof of any and all required (either by applicable government, port or Sponsor’s own) Covid-19 or any other vaccination, testing or health protocols in advance or at time of boarding the cruise vessel (originally or after any excursion), at winner/guests sole cost. Those without proper applicable citizenship health/vaccine protocols and documentation will be denied boarding. Sponsor will not be responsible if winner/guest are denied entry onto ship, into various ports during the cruise, or return entry into departure point. In such a situation, the winner/guest will be responsible for any and all additional costs incurred. Each traveler must check with their travel advisor, government agencies, embassies or consulates prior to their vacation to ensure that they have proper citizenship documentation. U.S. Citizens can also visit the State Department's travel website at www.travel.state.gov for more information. U.S. travelers of all ages are strongly encouraged to obtain passports. Prize elements may not be separated. Winner and guest must obey all ship and cruise rules and requirements, and failure to follow such rules and requirements may result in, without limitation, forfeiture of all or part of the Prize. Lost, stolen or damaged cruise tickets or any other ticket or certificate in connection with Prize will not be replaced or exchanged.

7) POTENTIAL PRIZE WINNER NOTIFICATION AND CLEARANCE: The potential winner will be contacted by the Administrator via email and will be required to complete, sign, and return the following documents (collectively, the “Documents”): [1] an Affidavit of Eligibility and Liability Release and, where legal, a Publicity Release; [2] a Travel Release for the Prize winner and Guest (if a minor is selected as a guest, Prize winner must be his/her parent/legal guardian); and [3] IRS Form W-9 to include winner’s social security number that will be used only for the purpose of reporting the winner’s prize earnings to the Internal Revenue Service (required for prize valued at $600 or more). If the winner (i) cannot be contacted after a reasonable attempt has been made by Administrator (as determined in Sponsor’s sole discretion); or (ii) fails to return the completed Documents by the date stated in the notification letter/email; or (iii) refuses the Prize; or (iv) the Prize or Prize notification is rejected or returned as undeliverable, then such potential winner will be disqualified and forfeits all rights to be deemed a winner and an alternate potential winner will be notified, time permitting. Upon Prize forfeiture, no compensation will be given.

8) OTHER INFORMATION: All federal, state, and other tax liabilities arising from the Prize are the sole responsibility of the Prize winner. Winner will receive an IRS Form 1099 for the actual value of the prize awarded. Prize value depends on market conditions at time of fulfillment. The difference in value of Prize as stated herein and value at time of notification, if any, will not be awarded. ARV of Prize is based on applicable information and fair market value of prize awarded may be reported for tax purposes where required by law. Sponsor and/or Administrator will not enter into any correspondence with non-winning entrants. These Official Rules prevail should there be any conflict or uncertainty relating to the Promotion based on information or advice provided by any of the Released Entities.

9) CONDUCT: By entering into this Promotion and/or receiving the Prize, Entrants and the Prize winner agree to be bound by these Official Rules and waive any rights to claim ambiguity in the Promotion or these Official Rules. These Official Rules are accessible at www.cruise-fcb-2024.com throughout the Promotion Period. Failure to comply with these Official Rules will result in disqualification. The Sponsor reserves the right, at its sole discretion, to disqualify any individual: (a) suspected of tampering with the Entry process or the operation of the Promotion; (b) acting in any manner deemed by the Sponsor to be in violation of the Official Rules; or (c) acting in any manner deemed by the Sponsor to constitute unsportsmanlike or disruptive behavior, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND COSTS (INCLUDING WITHOUT LIMITATION, ATTORNEYS’ FEES) FROM ANY SUCH PERSON, TO THE FULLEST EXTENT PERMITTED BY LAW.

10) LIMITATIONS OF LIABILITY: The Released Entities as defined in Rule #2 above assume no responsibility or liability for (a) any incorrect or inaccurate Entry information, or for any lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of Entries at any point in the operation of this Promotion; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Promotion; (d) inaccessibility or unavailability of the Internet or any combination thereof; or (e) any injury or damage to the participant’s or to any other person's computer/mobile device which may be related to or resulting from any attempt to participate in the Promotion or download any materials from the Promotion. If, for any reason, the Sweepstakes is not able to run through completion for reasons which may include, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, including any other factors beyond Sponsor’s reasonable control such as a Force Majeure (e.g., war, riots, terrorism, civil unrest, strikes, blackouts, supply shortages, order of governmental authority,) an “act of God” (e.g., natural disasters, weather, etc.) or a public health event (e.g. pandemic or epidemic), then the Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, without further liability to the Entrants or third parties. In the event the Sweepstakes is cancelled, Sponsor reserves the right to award the Prize from among all eligible non-suspect Entries received prior to the time of the action or event warranting such cancellation. With regard to this Sweepstakes, the Sponsor will only contact those Entrants deemed a potential winner for purposes of clearance and awarding of the Prize. These Official Rules prevail should there be any conflict or uncertainty relating to the Sweepstakes based on information or advice provided by any of the Released Entities.

11) ENTRANT AND WINNER RELEASES: All Entrants, as a condition of Entry into the Promotion, agree to release and hold harmless the Released Entities from and against any and all liability, loss, claims, demands or actions of any kind whatsoever for injuries, damages, costs, or losses to persons or property which may be sustained in connection with: (a) accessing the online Entry form; (b) submitting an Entry or otherwise participating in any aspect of the Promotion; (c) the acceptance, receipt, ownership, use or misuse of any prize awarded; (d) any typographical or other error in these Official Rules or the announcement of the offering of the Prize; or (e) any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property-related cause of action. The Prize winner recipient shall bear all risk of loss or damage to the Prize after it has been delivered.

Entrants agree to be bound by these Rules and consent to the use of their names, address, photographs, any statements made by Entrants, actual or simulated likenesses, and/or biographical information for public relations, advertising and promotional purposes in perpetuity, throughout the universe, by Sponsor and its designees in any and all media, whether now known or hereafter devised, without notice or further compensation, unless prohibited by law.

12) PRIVACY: By entering the Promotion, you grant the Released Entities permission to use your personal information in accordance with Sponsor’s privacy policy located at https://www.massport.com/massport/about-massport/privacy/. By participating in the Promotion, Entrants hereby acknowledge that they have read and accepted Sponsor’s privacy policy. Information collected from Entrants (such as name, postal address and email address) will not be re-used, sold or shared in any manner by the Sponsor or any third parties unless Entrant has opted-in to receive additional information and marketing or promotional material from the Sponsor or a third party.

13) GENERAL: Any attempt by a person to use multiple e-mail accounts to enter more than once will result in disqualification. Entries will be deemed made by the authorized account holder of the e-mail address submitted/used at time of Entry. In the event of a dispute over who submitted a winning Entry, the authorized account holder of the e-mail address associated with the winning Entry will be declared the winner. “Authorized Account Holder” is defined as the natural person assigned to an e-mail address by an Internet access provider, on-line service provider, social networking site or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address in question. Potential Prize winner may be asked to provide Sponsor with satisfactory proof that he/she is the Authorized Account Holder of the e-mail address associated with a potential winning Entry. Entry generated by a script, macro or other automated means will be disqualified. Entries that are incomplete, illegible or corrupted are void and will not be accepted.

14) DISPUTES AND GOVERNING LAW: This Sweepstakes is conducted in English (which will be given its everyday ordinary meaning), and any and all disputes will be resolved in the appropriate courts in the Commonwealth of Massachusetts exclusively, and subject to the laws of the Commonwealth of Massachusetts. Should there be a conflict between the laws of the Commonwealth of Massachusetts and any other laws, the conflict will be resolved in favor of the laws of the Commonwealth of Massachusetts. Entrants irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non-conveniens or lack of personal jurisdiction they may have. To the extent allowed by law, Entrants will not be permitted to obtain awards for, and each Entrant hereby waives, all rights to claim punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses.

15) WINNER’S LIST: To receive a copy of the winner’s List, available after May 31, 2024, send an email with subject line: "Wave Season CCNE Sweepstakes" to winnerslist@mardenkane.com. All such requests must be received by June 30, 2024.
